What are the trademark licensing terms for using a pro sports teams logo on a blog? or on a website in general? If I started a blog called cowboysblue&sliver.com, where I wrote about the the Dallas Cowboys and such, do I have to receive permission to use their logo on my site? Is it legal for a auto body shop to take parts off and not put them back on? My daughter was hit by an uninsured motorize and took my car to Toyota of Dallas for an estimate on repairs. While the vehicle was in their possession they choose to rip off the bumper and side panel to check for additional body damage. They never asked to that and certainly never called me for permission. I am the owner of both the vehicle and the Geico policy holder. My daughter is only 17 and has no legal right to sign any sort of monetary contract. I received a call from the Geico adjuster explaining that they were not going to cover $2000.00 of brake related repairs. The adjuster believed they were not accident related. Toyota of Dallas collision repair shop and after they verified my out of pocket expense was going to be around $2000.00 I had no choice but to refuse the service and have the vehicle to a less expensive place for the brake repairs. I paid Toyota of Dallas $477.37 and another tow service $140.00 to have the vehicle towed to Just Brakes. My daughter goes to pick up the car and is outraged at its condition. The vehicle has no bumper, no side panel, and no headlight. Just Brakes verified this was the condition it was in upon its arrival to their shop being delivered from your dealership. I called Jr in the collision shop to be told that they don't put damaged parts on vehicles. I told them no one ever told them to remove the parts. I took a 10 hour flight from Frankfurt to Philadelphia and brought two iPods with me just incase one dies...well because the outlets in Europe are different than the ones here they didn't charge properly and both died two hours into the flight and I was stuck listening to 5 little girls sing kiddy songs for 8 hours straight.

Do you think the NBA fixes games? The NBA doesn't fix games. That's impossible. And stupid. It could never happen. But there are three major problems here. First, Dwyane Wade shot as many free throws (25) as the entire Dallas team in Game 5. I just don't see how there's any way this can happen in a fairly-called game. It's theoretically impossible. Second, everyone knew the officiating would be a problem heading into this series because of Cuban's past problems with the league. No team depends on the refs quite like the Heat. When the refs are calling all the bumps on Shaq and protecting Wade on every drive, they're unstoppable. When they're calling everything fairly, they're eminently beatable. If they're not getting any calls, they're just about hopeless. The officiating in Game 3 (the last five minutes were just obscene) and Game 5 (again, a top-five debacle) was absolutely atrocious. Third, here's a theory on referees that was described in a blog last spring: "I don't think the NBA fixes games, but they have one trick that they use for situations like this -- when they want a home team to win the game, they invariably assign the worst referees possible to that game for two reasons: Bad referees have a tendency to get swayed by the home crowd, and bad referees never have the stones to make a tough call on the road. In a related story, I went to 35 Clippers games this year and kept a list of the referees in my pocket which I also used to follow the referees for any televised games. And yes, the referees in the NBA -- as a whole -- have never been worse. But there were six referees that stuck out as being especially terrible." Then I went on to list the worst six referees. Here was No. 2 on the list: "2. Bennett Salvatore -- Always one of the worst, he took it to another level this season. If you see him on the court at the start of the game, get ready for about six technicals, two near-brawls and both coaches having to be restrained by their assistants at various times." Why is this relevant? Not only did Salvatore officiate Game 4 of the Suns-Lakers series (the one where Kobe tied it at the end of regulation and won it at the end of OT on two shaky non-calls on Nash, both by Salvatore), not only did Salvatore officiate Sunday night's Game 5 (in which Miami had a 40-12 free-throw advantage at one point), but Salvatore called the foul on Wade's final drive in overtime (remember, the call where ABC couldn't find a replay to show that anyone touched him?) even though he was standing at midcourt a full 35-40 feet from the play, and even though two other refs were closer to the play. Not only was that NOT his call, he butchered it. I'm asking OTHER people you know. I'm just sharing my views and letting people know the facts

Question about the Light Dreams and Nightmares Tour featuring Drake.? Hi everyone! I'm pretty sure those of you that follow Drake know that he has just announced the dates for his fall tour. Although it was on the blog, when I went on ticketmaster the date was nowhere to be found! What percentage of Americans feel the same? My husband actually wrote this on his blog, donaldgallinger.com, and I'm wondering how others are feeling in the Yahoo community: Recently, the Dallas Public School system implemented a new grading policy intended to ensure “fair and credible evaluation of learning—from grade to grade and school to school.” Here are the key points in this plan: 1. Homework grades should be given only when the grades will “raise a student’s average, not lower it.” 2. Teachers must accept overdue assignments, and their principal will decide whether students are to be penalized for missing deadlines. 3. Students who flunk tests can retake the exam and keep the higher grade. 4. Teachers cannot give a zero on an assignment unless they call parents and make “efforts to assist students in completing the work.” I don’t teach in Dallas, but I am a public high school teacher of nearly twenty-five years, and I can tell you that similar policies are creeping into school systems across the country. Soon, I believe, these blueprints for teaching students to ignore—or even celebrate—mediocrity and failure will become commonplace practices in our nation’s public schools. For the politically naïve (and yes, the shaping of school policy is ultimately political), here is why every student must be forced to “succeed” on paper: It’s because public schools can’t tell the truth. And the truth is that as a society, we are becoming incapable of raising children to be responsible adults. The reasons are deep, systemic, and will probably not change for at least a few generations. In the meantime, schools must continue to lie to the public as long as the public keeps lying to itself, because the alternative would be political suicide. We have educated our children to be excellent consumers—and not much else. Soon, we will see the full fruition of these, our true values, as a society. Not only will our kids have neither the skills nor the patience required to run the infrastructure of our country, they will also lack the emotional maturity to understand or learn from their failures. So I offer this piece of advice to the Dallas Public School system—and any other school facing similar problems with student failure rates: You’re off to a good start, but keep up the momentum. Inevitably, students who flunk tests will want not just a second chance, but a third and a fourth. Give it to them. Eliminate the grade of “zero” on any assignment. Award academic points on tests for simply showing up at school. Create an “action plan” for each individual student depending solely on his tastes and interests. For example, if a student cannot master simple addition and subtraction, then allow him to draw an impressionistic picture of mathematical operations. If a student doesn’t like reading, let him watch television and then perform an interpretive dance of what he’s seen. Lastly (and most importantly), MAKE SURE THAT EVERY STUDENT GRADUATES. Put on a lavish show for the graduation ceremony, the gaudier the better. Parents and kids love graduation. They like to scream and holler and take pictures and videos of the grand event. It means absolutely nothing—or soon will—but that’s not important. What’s important is the appearance of achievement. In the end, appearance is all you’ve got to work with. So make it count. You’re in show business now, Dallas Public School system. Give the folks a good show. I’ll be retired from public school teaching in less than two years. It’s just as well. I don’t have a flair for tap dancing or the guts to be part of a criminal conspiracy to violate the public’s trust.

The first thing that immediately came to my mind was that 2008 is the tenth anniversary of the lynching of James Byrd, Jr. in Jasper, Texas. Liken unto that case, the victim in Paris was said to be a 24-year-old Black man and his killers were two White men. I immediately Googled the town and saw that there were only a handful of media outlets that had covered the story which involved Brandon McClelland and these two White males. One reason possibly that there was hardly any coverage was that this killing took place on September 16, which was the tail end of Hurricane Ike hitting landfall so I am sure the town officials were hoping this would be swept under the rug. Too bad, because the Final Call is on top of it! Sister Kyrtle told me that members of the NBPP Dallas Chapter were on the grounds already to meet with the family. So myself, Sis Krystle and my older brother Deric Muhammad hit the road on Sunday, October 5 to do some on the grounds work to see what really happened. After a five hour drive, we arrived in the 'hood of Paris. We then caravaned over to the home of the McClelland family where Brandon's mother sat on the porch with tears in her eyes. Ms. Jacqueline McClelland and her family gave recorded statements to me for my Final Call story as well as the NBPP for an independent investigation. We were also joined by local activists, a head of the State NAACP chapter and other friends of the family. After hearing their accounts, it was verified that her son was dragged on the back of a pickup truck by these two White males and his body was dismembered. Jasper all over again. Afterwards we drove over to the grave site. We then went to the scene of the crime in Lamar County. You would not believe that parts of that Brandon McClelland's skull was still out there on the ground! Shows how much the police cared. It was like an episode of CSI:NY with blood tracks up and down the road and tire marks chased by the blood trails. This was one of the most painful stories I have had to cover in person. They tied my son to that truck and drugged him until his body parts were detached", said his mother Jacqueline McClelland to the Final Call. "His body was so destroyed that it could not even be embalmed by the funeral home. This is a hate crime. I don't want the death penalty for these killers because that would be too quick. Are Dirk Nowitzki and Duncan the two most humble superstars in the NBA, and best considered as class acts? +BQ? I mean c'mon, some of the top players in the NBA aren't humble at all and are extremely arrogant and ignorant. Like to name a few, Kobe (throwing Bynum under the bus, treated his maid like a mule, acting arrogant on the court constantly) KG, Shaq, and more. Dirk on the other hand is the best definition of a class act along with Duncan. He never puts other young players down and use to sit with Diop when he played in Dallas and help his confidence when he got down (which was very often by the way) and I heard this one reporter was lost in the Dallas arena and Dirk took the time to show him around and even offered to answer all his questions when he didn't have too. Last, in the 2007 series against the Warriors Dirk's father was going through surgery on his lung due to a life of smoking and he had to call during halftime of every game in that series and it was on his mind (therefore poor performance) and Avery wanted to tell the media and Dirk told him no its ok.
